Hey im on a $140 telecom smartplan with a iphone4s. When the new iphone5 comes out can i upgrade it?

Yes, but it might cost you a lot. If you have a 2 year term (most plans are two years so it is very likely) then there will be some sort of termination fee. That is likely to be several hundreds of dollars. You will need to call Vodafone to find out exactly.

I could be wrong (it's been happening a lot lately), but I think you'll find the contract, if there is one, is only for the plan, they don't care what phone you use.
So with that in mind, there is no reason you cant change phones. It won't be an upgrade as such. You'd have to by a new phone, and deal with the old one yourself.
The best thing to do, is ask Telecom. A $140 plan is substantial, if they consider you to be a valuable customer they may well want to keep you happy.
